I understand your frustration, but you have the upper hand whether you realize it or not. So let me ask you a few questions.

Where is the car now?
Is it stable enough for you to drive it?
Are you using another vehicle?
Do you have a case number with VWOA?
When is your next appointment, to let the regional tech take a look at your car? That is the next step, attempt #3.

Again, if you like the car (when it's running), then you should aim for a permanent fix. If you're done with it, you should lobby for a buyback or lemon law. Usually the buyback is best as there is no depreciation involved.

Your next step should be to set up the service with the VWOA regional tech. They will usually suggest parts replacement. Get that done.

I have the car now.. for now yeah there isnt a CEL or EPC light after they reset it but I am just waiting on it to reappear.

I do have a case number with VWoA and would like a permanent fix so I can sell it since the regional VWoA guy talked to me and said that a buyback was a miscommunication. So if they cant fix it ill aim to have it lemoned.. VW is fighting me left and right to fix my own car every step of the way. I dont know why the regional guy was also so difficult. The only helpful person was the customer service rep that brought up the word buyback but again she miscommunicated that to me.

I dont really know what more to do to push for a buyback at this point. Ive been checking to see what I can get for it on trade but its nothing near what I would get on a private sale (taking the sales tax credit into account).

This is what I would do.

Make the appointment with the regional tech to look at the car. You need to get to attempt #4 to lemon law the car, at least that's what I see when I check KY law.

In the meantime, every few days, grab a log from your scanner. The codes you posted look like a bad wastegate or turbo. This should be a no-brainer for your dealer to fix.

The regional rep called me back today (my day has been busy as hell) and told me a local dealer (30 miles away) has a loaner and ill be taking it in next Friday as long as the codes pop back up. Id honestly be surprised if they didnt pop up again. He said he wasnt aware of any tests done by plugging things into the turbo like the first dealer told me (surprise?). But I understand they cant do much if there isnt an EPC light or Check engine light.

I agree with you about the wastegate. Thats what I was seeing by other people's posts on reddit and the different forums.

Well no CEL still.. I cancelled my appointment for today and will just take it in if it starts having issues again. 🤷‍♂️

VW even told me as much if there was no CEL or EPC light they couldnt do anything (this was when I called to make appointment #3).

Maybe it fixed itself? I wouldn't blame you though if you couldn't trust the car ever again. I know I'd feel uneasy about taking it on longer trips at least.
